1. MATERIALS: All natural quarried materials may vary and all goods are sold subject to these natural variations, therefore cannot be guaranteed identical to any sample material. All sizes are approximate and in imperial measurements may be converted metric or vice versa.
2. DETAILS: The buyer should check the details of the order confirmation, particular care should be taken in the spelling of names and accuracy of dates. Any alterations should be notified within 7 days of acceptance of the order and confirmed in writing by both parties. J W Myers cannot otherwise take any responsibility for any errors in an inscription on Goods which comply with the terms of the order. It is the Buyers responsibility to ensure all inscription spelling is correct on signature of the order confirmation.
3. COMPLETION & WARRANTY: Due to the high demand on our services and taking into account we are a small family business we do have a wait list, this is due to us offering the highest quality workmanship at the best possible price whilst also offering a 10 year warranty on all memorial fixings, 5 year warranty on all ornamentation and 1 year warranty on all lettering paint. J W Myers will endeavor to deliver goods within the timescale specified, usually 12 – 16 weeks for memorial plaques / refurbishments and 6 - 9 months for upright memorials / kerb sets. If you require a particular date of completion and fitting of the memorial please inform us and we will do our upmost to meet this the specified date. We always ensure to have goods fitted in a reasonable timescale. J W Myers cannot take responsibility of works being delayed through strikes, lockouts, lockdowns, accidents, late delivery of materials to the seller or other force majeure. Please note that delivery of goods can be delayed if you require a large bespoke item that requires shipping from abroad, this can be common with large slate / limestone pieces. We will always keep you informed of timescales if required however time shall not be of the essence of the contract unless expressly agreed in writing.
4. TITLE: the Title in the Goods remains vested in J W Myers and shall not be passed to the Buyer until full payment of the goods are received by the Seller.
5. PAYMENT: As specified, a 50% deposit is required on completion of the Order Confirmation, this is to ensure security of the order. Until a deposit is made J W Myers shall not be obliged to commence any work and any date for completion of the order shall be extended by the period of any delay in payment of the deposit. The remaining balance of the price for the Goods shall be due once we physically have the memorial stone, any proofs signed and approval from the burial ground has been granted.
6. FEES AND VAT: The Buyer is responsible for the fees to cemeteries and churchyard authorities but are usually paid by J W Myers and added to the invoice on completion of the Goods. If at any time the charges are increased prior to the completion of the Goods, the difference shall be paid by the Buyer to the Seller. VAT will be payable at the current rate of 20% and applicable at the date of invoice or at the date of payment.
7. Cancelling an order
If you wish to cancel an order with us, this can be done in writing within 14 days of the order being placed with no costs incurred unless we have incurred costs on your behalf, this includes burial ground fees and unforeseen expenditure.
8. Security measures
Ensuring your data remains safe is our top priority and we have security measures in place. We work hard to maintain the physical and digital protection of your data, ensuring that access is restricted to only those who need that information to be able to successfully complete their work.
If it is necessary for us to share your personal information with third parties (i.e Funeral Directors or Burial Ground officials) and we have your consent to do so, we’ll make sure your data is protected during the transfer.
9. Controlling your personal data
We understand that there will be times when clients wish to cancel their order and they can do so within a 14 day period of placing the order
Though we’d be sad to see you go, we’ll respect your wishes and securely remove your personal information from our database.

Once we’ve completed the work you have requested of us, we will retain your data for 5 years. After this point, if you have not come back to us for additional services, we’ll remove you from our database.
